A total of 116 farmers from Mamburao, Paluan, and Sablayan, in the Province of Occidental Mindoro, were recently given a three-day free-legal service by the lawyers of the Department of Agrarian Reform (DAR), which include information dissemination, free legal consultation, and counseling to the agrarian reform beneficiaries (ARBs).
DAR Regional Director Marvin Bernal said the DAR offices in the province noticed that it was difficult for the farmers to go directly to the DAR offices to seek legal advice on their lands so they developed the “Lawyers to the Benepisyaryo” program, where the agency’s lawyers will be the one to personally go to the farmers to hear their grievances and problems.
The project was introduced during the Covid-19 Pandemic in 2021. To help avoid the spread of the disease, instead of the farmers going to DAR offices for their legal queries, they were instead visited by DAR lawyers in their municipalities to provide free legal assistance with agrarian reform-related issues and concerns.
The Agrarian Reform Justice on Wheels (ARJOW), another DAR program was also brought to the farmers of Occidental Mindoro.
“We will also provide these free-legal services to the rest of the Mimaropa (Mindoro, Marinduque, Romblon, Palawan) region throughout the year,” Bernal said.
During the free consultation, some of the problems they raised included problems with the size of the land and the placing of the markers in the area. Among the topics discussed in the consultation were retention, mediation, compulsory arbitration, and rights and obligations of farmer-beneficiaries.
The DAR, at present, utilizes aggressive alternative dispute resolution techniques in mediation to reduce conflicts maturing into court cases.
The general objective is to persuade the contending parties to settle their disputes amicably or out of court before the DAR.
The free-legal services are part of the promise of DAR Secretary Conrado M. Estrella III to bring the government closer to the people.

Sinabi ni DAR Regional Director Marvin Bernal na napansin ng DAR na mahirap para sa mga magsasaka na direktang pumunta sa mga tanggapan ng DAR upang humingi ng legal na payo sa kanilang mga lupain, kaya binuo nila ang programang “Abogado sa mga Benepisyaryo,” kung saan ang mga abogado ng ahensya ang siyang pupunta sa mga magsasaka upang marinig ang kanilang mga hinaing at problema.
Ang proyekto ay ipinakilala noong panahon ng Covid-19 Pandemic noong 2021. Upang makatulong na maiwasan ang pagkalat ng sakit, sa halip na ang mga magsasaka ang pupunta sa mga tanggapan ng DAR para sa kanilang mga legal na katanungan, binisita sila ng mga abogado ng DAR sa kanilang mga munisipalidad upang magbigay ng libreng legal na tulong na may mga alalahanin na may kaugnayan sa repormang agraryo.
Ang Agrarian Reform Justice on Wheels (ARJOW), isa pang programa ng DAR ay dinala rin sa mga magsasaka ng Occidental Mindoro.
“Ibibigay din namin ang libreng-legal na serbisyong ito sa iba pang bahagi ng rehiyon ng Mimaropa (Mindoro, Marinduque, Romblon, Palawan) sa buong taong ito,” ani Bernal.
Ang ilan sa mga problemang inihain nila ay tungkol sa mga problema sa laki ng lupa at ang paglalagay ng mohon sa lugar. Kabilang sa mga paksang tinalakay sa konsultasyon ay retention, mediation, compulsory arbitration, at mga karapatan at obligasyon ng mga farmer-beneficiaries.
Ang DAR, sa kasalukuyan, ay gumagamit ng agresibong alternatibong mga diskarte sa paglutas ng hindi pagkakaunawaan sa pamamagitan upang mabawasan ang mga salungatan na humahantong sa mga kaso sa korte.
Ang pangkalahatang layunin ay hikayatin ang mga nag-aaway na partido na ayusin ang kanilang mga hindi pagkakaunawaan nang maayos o sa labas ng korte sa harap ng DAR.
